Terms of Service

Effective date: June 27, 2026

These Terms of Service govern your use of The BlackSmith website, portfolio, inquiry forms, consultation paths, and related online services.

By using the website, submitting an inquiry, or communicating with The BlackSmith through the website, you agree to these terms.

Who We Are

The BlackSmith is a Los Angeles-based tattoo artist brand available for custom tattoo work and select travel appointments.

Website Use

The website is provided for portfolio viewing, inquiry, consultation, booking, and communication purposes.

You agree not to:

  • Use the website for unlawful, abusive, fraudulent, or harmful activity
  • Interfere with the security or operation of the website
  • Submit false, misleading, unauthorized, or infringing content
  • Copy, scrape, reuse, or redistribute site content without permission
  • Submit private information about another person without permission

Tattoo Inquiries And Consultations

Submitting an inquiry does not guarantee an appointment, tattoo design, quote, travel booking, or confirmed session.

A tattoo appointment is confirmed only when The BlackSmith confirms the appointment directly and any required deposit, payment, consent, or booking step has been completed.

Tattoo projects are accepted at the artist's discretion. The BlackSmith may decline or postpone a project if the request is outside the artist's scope, unsafe, not legally permitted, conflicts with existing commitments, cannot be executed appropriately, or otherwise is not a fit.

Age And Identification

Tattoo services are intended for adults. Clients must provide valid government-issued identification and satisfy age requirements under applicable law and The BlackSmith policy.

For California tattoo services, clients should expect an 18+ requirement.

Requirements may vary for travel work depending on the location, venue, event, or applicable local law. The BlackSmith may still apply an adult-only policy even where another jurisdiction has different rules.

Health, Safety, And Suitability

Tattooing involves skin, needles, ink, healing, aftercare, and personal health considerations. Website content is for general information only and is not medical advice.

Clients may be asked to complete consent, health/safety screening, and aftercare acknowledgment steps before a tattoo appointment. Do not submit highly sensitive health information through a general website form.

The BlackSmith may refuse, reschedule, or stop service if a client appears intoxicated, unable to consent, unsafe to tattoo, medically unsuitable, abusive, threatening, noncompliant with safety requirements, or otherwise not appropriate for the procedure.

Clients are responsible for following preparation and aftercare instructions. Healing outcomes can vary based on skin, placement, lifestyle, aftercare, health, sun exposure, friction, and other factors outside the artist's control.

Pricing, Deposits, And Payments

General pricing information may be shared on the website, in ads, or during consultation. A final price or session type may depend on concept, size, placement, detail, color, body area, travel, and time required.

If a deposit is required, the deposit amount, payment method, cancellation terms, rescheduling terms, and refund terms should be provided before payment.

Payments, deposits, taxes, or related transaction features may be handled by Squarespace or other third-party payment providers when enabled. Those providers may have their own terms and policies.

Travel Appointments

The BlackSmith may travel for tattoo work, guest spots, events, conventions, or private projects. Travel availability is limited and subject to location, schedule, legal requirements, venue requirements, health/safety rules, and artist discretion.

Travel inquiries do not guarantee that The BlackSmith will be available in a particular city or on a particular date.

Client References And Submitted Materials

If you submit reference images, sketches, photos, descriptions, or other materials, you confirm that you have the right to share them and that your submission does not violate another person's rights.

You grant The BlackSmith permission to review and use those submitted materials internally for consultation, design planning, pricing, scheduling, and communication about your tattoo request.

Do not submit copyrighted artwork, private photos, or personal information unless you have permission and understand that it is relevant to your request.

Portfolio, Photos, And Public Use

The website may display tattoo work, portfolio images, videos, process content, sketches, and brand materials. These materials are owned by or licensed to The BlackSmith and may not be copied, reproduced, reposted, sold, modified, or used for commercial purposes without permission.

Client tattoo photos, finished-work photos, process photos, or related content should only be used publicly when permitted by the client, captured in a public/approved context, or otherwise approved for public use.

Third-Party Services

The website may use or link to third-party services, including Squarespace, scheduling tools, payment processors, Instagram, Facebook, Meta, Google, analytics tools, maps, or other integrations.

The BlackSmith is not responsible for third-party websites, platforms, outages, content, privacy practices, or terms.

No Guarantee

The BlackSmith makes reasonable efforts to keep website information accurate, but the website may contain errors, outdated information, broken links, unavailable services, or incomplete details.

Tattoo results, appointment availability, healing, and final project scope are not guaranteed by website content.

Limitation Of Liability

To the fullest extent permitted by law, The BlackSmith is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from website use, third-party services, unavailable features, or reliance on website information.

Nothing in these terms limits liability where the law does not allow a limitation.

Changes To These Terms

These terms may be updated from time to time. Updates will be posted on this page with a revised effective date.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless another law is required to apply.
